COMMITTEE SUBSTITUTE

An Act relating to environmental and natural
resources; exempting property that is part of the
Conservation Commission Cost-Share Program from
eminent domain; providing purpose for protection from
eminent domain; providing exceptions; providing for
codification; and providing an effective date.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 3-3-118 of Title 27A, unless
there is created a duplication in numbering, reads as follows:
To protect natural resources and landowner rights, private lands
that are entered into the Cost-Share Program are exempt from eminent
domain. This protection will ensure the longevity of conservation
efforts, with exemptions granted only for eminent domain projects
essential to safeguarding public health and including those projects

which involve the transmission or distribution of electricity or
natural gas.
SECTION 2. This act shall become effective November 1, 2026.
