BILL NO. 2156 By: Dobrinski of the House

Murdock and Pederson of the
Senate

An Act relating to property; providing setback
requirements for utility scale solar energy and
associated battery storage facilities; providing when
setback requirements shall apply; providing for
codification; and declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 1501 of Title 60, unless there
is created a duplication in numbering, reads as follows:
A. Utility scale solar energy and associated battery storage
facilities, excluding residential solar energy panels, shall have
the following setback requirements:
1. Shall not be located within five hundred (500) feet of an
occupied residence unless waived in writing by the owner of the
residence;
2. Shall not be located within fifty (50) feet of any outer
boundary of the facility property;

3. Shall not be located within one hundred (100) feet from the
centerline of any public road; and
4. Shall not be located within a half (1/2) mile from any
public school or hospital.
B. This act shall apply to ten (10) megawatt and larger solar
energy and associated battery storage facilities. Furthermore, this
act shall apply to any project in development that does not yet have
an interconnection agreement in place on or after the effective date
of this act.
SECTION 2. It being immediately necessary for the preservation
of the public peace, health or safety, an emergency is hereby
declared to exist, by reason whereof this act shall take effect and
be in full force from and after its passage and approval.
