HOUSE BILL 2938 By: Olsen

AS INTRODUCED

An Act relating to elections; prohibiting individuals
with no intent to return to Oklahoma from voting in
state or local elections; permitting individuals with
no intent to return to Oklahoma to vote in national
elections; prohibiting individuals with an indefinite
intent to return to Oklahoma from voting in state or
local elections; permitting individuals with an
indefinite intent to return to Oklahoma to vote in
national elections; prohibiting individuals who vote
in another state or country's elections from voting
in state or local elections; permitting individuals
who vote in another state or country's elections to
vote in national elections; providing exceptions for
individuals and spouses employed by the federal
government or state; clarifying act does not apply to
individuals with intent to return to Oklahoma;
providing for codification; and providing an
effective date.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 4-125 of Title 26, unless there
is created a duplication in numbering, reads as follows:

A. Individuals who move into another state or country with the
intention of making that state or country their permanent residence
shall be permitted to vote in only national elections and shall not
be permitted to vote in state elections, county elections, municipal
elections, or any election of subdivisions thereof.
B. Individuals who move into another state or country with the
intention of remaining there an indefinite time, and make that state
or country their place of residence, shall be permitted to vote in
only national elections and shall not be permitted to vote in state
elections, county elections, municipal elections, or any election of
subdivisions thereof.
C. Individuals who move into another state or country and,
while there, vote in an election held by that state or county shall
be permitted to vote in only national elections and shall not be
permitted to vote in state elections, county elections, municipal
elections, or any election of subdivisions thereof.
D. Subsections A, B, and C of this section shall not apply to
individuals, or their spouses, who are employed in the service of
the federal government or the State of Oklahoma and are required
thereby to be absent from where that individual resided when
entering that employment.
E. Subsections A, B, and C of this section shall not apply to
individuals who move into another state or country for temporary
purposes only, with the intention of returning to Oklahoma.

SECTION 2. This act shall become effective November 1, 2026.
