2nd Session of the 60th Legislature (2026)

HOUSE BILL 2949 By: Tedford

AS INTRODUCED

An Act relating to child care facilities; providing
legislative finding; directing that licensed child
care facilities maintain certain staff-to-child
ratios; directing the Department of Human Services to
promulgate rules; providing for codification; and
providing an effective date.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 405.6 of Title 10, unless there
is created a duplication in numbering, reads as follows:
A. The Oklahoma Legislature finds that maintaining safe,
developmentally appropriate child-to-staff ratios is essential for
protecting the welfare of children in licensed child care centers
while promoting accessibility and affordability for Oklahoma
families.
B. Licensed child care centers shall maintain the following
minimum staff-to-child ratios:

1. For children from birth through eleven (11) months of age,
there shall be one (1) staff member for every five (5) children;
2. For children from twelve (12) months of age through twenty-
three (23) months of age, there shall be one (1) staff member for
every six (6) children; and
3. For children from twenty-four (24) months of age through
forty-seven (47) months of age, there shall be one (1) staff member
for every seven (7) children.
C. The Department shall promulgate any rules necessary to bring
the Oklahoma Administrative Code into conformity with this act.
SECTION 2. This act shall become effective November 1, 2026.
