HOUSE BILL 2977 By: Timmons of the House

Hicks of the Senate
AS INTRODUCED
An Act relating to motor vehicles; defining terms;
authorizing the placing of hidden disability
indicator on certain forms of identification;
providing for optional participation; allowing
Service Oklahoma to require certain documents;
requiring indicator not specify disability; allowing
removal of indicator without penalty; stating
requirements for indicator; describing prohibited
uses of the indicator; authorizing the promulgation
of certain rules; providing for codification; and
providing an effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 6-131 of Title 47, unless there
is created a duplication in numbering, reads as follows:
A. As used in this section:
1. "Hidden disability" means a non-obvious physical,
neurological, sensory, cognitive, or developmental condition that

may affect communication, perception, movement, or behavior during
interactions with law enforcement, including, but not limited to:
a. autism spectrum disorder,
b. deafness or significant hearing impairment,
c. speech impairment,
d. cognitive or neurological conditions, and
e. physical conditions that may limit mobility or motor
response.
2. "Indicator" means a standardized logo, symbol, or notation
approved by Service Oklahoma that signifies the licensee or
cardholder has voluntarily elected to disclose the presence of a
hidden disability.
B. Service Oklahoma shall allow an applicant or licensee to
voluntarily elect to have a hidden disability indicator placed on a
driver license or state-issued identification card. No person shall
be required to disclose a disability or participate in the program
as a condition of licensure or identification. Service Oklahoma may
require a signed self-attestation or other reasonable documentation
as determined by rule, but shall not require disclosure of a
specific diagnosis, medical records, or detailed health information.
The indicator shall not specify the nature or category of the
disability. A licensee or cardholder may request removal of the
indicator at any time. Service Oklahoma shall remove the indicator
without penalty or explanation upon request.

C. The indicator shall be discreet and standardized statewide,
clearly recognizable by law enforcement, and nonstigmatizing in
appearance and language. The indicator shall not include text
describing the disability.
D. The indicator shall not be stored or searchable as a medical
record. The presence of a hidden disability indicator:
1. Shall not create probable cause or reasonable suspicion;
2. Shall not be used for investigative, enforcement, or
profiling purposes; and
3. Shall not be disclosed for purposes other than official
identification.
E. Service Oklahoma is authorized to promulgate rules to
effectuate the provisions of this section.
SECTION 2. This act shall become effective November 1, 2026.
