An Act relating to motor vehicles; creating the Talyn
Bain Act; defining term; requiring the Department of
Transportation establish school zones on certain
state highways upon request; requiring local
jurisdiction be responsible for certain maintenance
and costs; stating when reduced speeds shall be in
effect; requiring Department make certain
installations on state highways; authorizing
Department to consult with certain interested
parties; setting penalty for violations; providing
for codification; and providing an effective date.
SUBJECT: Motor vehicles
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 11-811 of Title 47, unless there
is created a duplication in numbering, reads as follows:
A. This act shall be known and may be cited as the "Talyn Bain
Act".
B. For the purposes of this section, the term "school" means a
public school operated by a school district or a private school, as
those terms are recognized under Title 70 of the Oklahoma Statutes,
that provides instruction in kindergarten through twelfth grade or
any combination of those grades.
C. Upon request of the appropriate local jurisdiction, the
Department of Transportation shall establish a maximum forty-five-

mile-per-hour school zone on any portion of a state highway that
meets any of the following conditions:
1. The highway consists of four or more lanes and passes
directly adjacent to the property boundary of the school;
2. The highway has a posted speed limit of sixty-five (65)
miles per hour or greater, lacks a grade-separated off-ramp or
frontage road providing access to the school, and passes directly
adjacent to the property boundary of the school; or
3. The center line of the highway is within one hundred fifty
(150) yards from the school property line.
D. Upon completion of construction of the school zone, the
local jurisdiction shall be responsible for the maintenance and cost
of operation of all school zone signage and equipment.
E. The reduced speed limit established pursuant to this section
shall be enforceable when the beacons are flashing and during:
1. School drop-off and pick-up times as indicated by flashing
beacons on the school zone signage; and
2. Any additional hours designated by the school district or
private school and approved by the Department of Transportation.
The Department shall erect signage with flashing beacons to
clearly indicate the beginning and end of the school zone.
F. The Department may consult with the affected school
district, private school administration, municipality, or county
commissioners prior to establishing a school zone in an area
pursuant to this section.
G. Any violation of the speed limit established pursuant to
this section shall be enforced in the same manner as other school
zone speeding violations established pursuant to Oklahoma law.
SECTION 2. This act shall become effective November 1, 2026.
