An Act relating to schools; directing the State
Department of Education, in certain consultation, to
establish the Binocular Vision Screening Program as a
two-year pilot program; directing the program to
offer vision screenings to students in kindergarten,
first, and third grades; defining term; requiring
schools to provide certain screening within certain
number of days beginning in certain school year;
requiring screenings to be performed by certain
personnel; clarifying certain requirement; directing
the Department to electronically submit certain
report by certain date and post it on its website;
creating the Binocular Screening Revolving Fund;
specifying source of fund; providing for
expenditures; providing purpose of fund; providing
for codification; providing an effective date; and
declaring an emergency.
SUBJECT: Schools
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 1210.286 of Title 70, unless
there is created a duplication in numbering, reads as follows:
A. The State Department of Education, in consultation with the
State Department of Health, shall establish a two-year pilot program
known as the Binocular Vision Screening Program for schools to offer
vision screenings to students in kindergarten and first and third

grades that are designed to identify convergence insufficiency.
“Convergence insufficiency” means a vision disorder characterized by
a decreased ability to converge the eyes and maintain binocular
fusion while focusing on a near target.
B. Beginning with the 2026-2027 school year, the program shall
require schools to provide all students in kindergarten and first
and third grades with a comprehensive binocular vision screening
within ninety (90) days of the start of the school year.
C. The screening required by subsection B of this section shall
be performed by personnel listed on the statewide registry
maintained by the State Department of Health pursuant to Section
1210.284 of Title 70 of the Oklahoma Statutes.
D. The screenings required by this section shall be in addition
to the screenings required in Section 1210.284 of Title 70 of the
Oklahoma Statutes.
E. The State Department of Education shall electronically
submit a report on the Binocular Vision Screening Program including
any legislative recommendations to the Governor, the President Pro
Tempore of the Senate, and the Speaker of the House of
Representatives by November 1, 2028. The Department shall post the
report on its website.
SECTION 2. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 1210.287 of Title 70, unless
there is created a duplication in numbering, reads as follows:
A. There is hereby created in the State Treasury a revolving
fund for the State Department of Education to be designated the
“Binocular Screening Revolving Fund”. The fund shall be a
continuing fund, not subject to fiscal year limitations, and shall
consist of all monies received by the State Department of Education
from monies appropriated or apportioned by the Legislature for the
purpose of implementing the provisions of Section 1 of this act.
All monies accruing to the credit of the fund are hereby
appropriated and may be budgeted and expended by the State
Department of Education for the purpose of establishing and
maintaining the Binocular Vision Screening Program created in
Section 1 of this act. Monies in the Binocular Screening Revolving
Fund shall supplement and not supplant existing school vision
screening funding.

B. Expenditures from the fund shall be made upon warrants
issued by the State Treasurer against claims filed as prescribed by
law with the Director of the Office of Management and Enterprise
Services for approval and payment.
SECTION 3. This act shall become effective July 1, 2026.
SECTION 4. It being immediately necessary for the preservation
of the public peace, health, or safety, an emergency is hereby
declared to exist, by reason whereof this act shall take effect and
be in full force from and after its passage and approval.
