An Act relating to parole; creating the Oklahoma
Elder Parole Eligibility Act; directing the Pardon
and Parole Board to grant parole to certain inmates;
providing list of qualifications; requiring the
granting of parole upon verification; directing the
Department of Corrections to review, certify, and
provide certain documentation to the Pardon and
Parole Board; prohibiting denial once certification
is made; providing list of mandatory exclusions;
subjecting paroled inmates to certain supervision
conditions; providing for the promulgation of rules;
providing for codification; and providing an
effective date.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 332.22 of Title 57, unless there
is created a duplication in numbering, reads as follows:

A. This act shall be known and may be cited as the "Oklahoma
Elder Parole Eligibility Act".
B. Notwithstanding the provisions of Section 332.21 of Title 57
of the Oklahoma Statutes and pursuant to the authority to grant
parole under Section 332.2 of Title 57 of the Oklahoma Statutes, the
Pardon and Parole Board shall grant parole to an inmate who meets
all of the following criteria:
1. The person is sixty-five (65) years of age or older at the
time of parole consideration;
2. The person is statutorily eligible for parole under Oklahoma
law;
3. The person has incurred no Class X infraction, Class A
infraction, or equivalent serious disciplinary infractions within
the preceding thirty-six (36) months;
4. The person has successfully completed all required programs,
treatment courses, educational programs, or vocational programs
required by the Department of Corrections or its substantial
equivalent, as determined by the Department;
5. The person has maintained continuous compliance with
institutional rules and regulations; and
6. The person does not fall within an exclusion provided for in
subsection E of this section.
Upon verification by the Department of Corrections that all
criteria have been met, parole shall be granted by the Pardon and

Parole Board without discretionary denial, subject only to standard
conditions of parole supervision.
C. The Department of Corrections shall:
1. Automatically review inmates who are sixty-five (65) years
of age or older for eligibility under the provisions of this
section;
2. Certify in writing to the Pardon and Parole Board that the
inmate meets the criteria set forth in subsection B of this section;
and
3. Provide documentation to the Pardon and Parole Board of
disciplinary history, program completion, and age verification.
D. The Pardon and Parole Board shall not deny parole once
certification by the Department of Corrections is completed and
submitted to the Board as provided for in subsection C of this
section.
E. The mandatory parole provisions provided for in this section
shall not apply to the following:
1. Inmates serving sentences of life without parole;
2. Inmates convicted of offenses for which parole is expressly
prohibited by statute;
3. Inmates who present a documented and articulable threat of
imminent physical harm to others supported by clear and convincing
evidence which shall include a verified medical or psychological
finding of dangerousness within the previous twelve (12) months; and

4. Criminal offenses listed in Section 13.1 of Title 21 of the
Oklahoma Statutes, any criminal offenses requiring registration as a
sex offender pursuant to the Sex Offenders Registration Act, or any
criminal offenses listed in Section 571 of Title 57 of the Oklahoma
Statutes.
F. Inmates paroled under the provisions of this section shall
be subject to the following:
1. Standard parole supervision conditions;
2. Age-appropriate supervision requirements;
3. Medical or treatment continuation plans, where applicable;
and
4. Any reentry or transitional services deemed necessary by the
Department of Corrections or Pardon and Parole Board.
G. The Department of Corrections and the Pardon and Parole
Board shall promulgate necessary rules to implement the provisions
of this section; provided, however, such rules shall not impose
additional eligibility barriers beyond those established in the
provisions of this section.
SECTION 2. This act shall become effective November 1, 2026.
