HOUSE BILL 3206 By: Humphrey

AS INTRODUCED

An Act relating to removal; providing for removal of
members of the Council on Judicial Complaints for
failure to properly discipline any person occupying
positions subject to the jurisdiction of the Court on
the Judiciary; requiring the Attorney General to
investigate; directing the Attorney General to
initial proceedings for complaints with reasonable
cause before the Supreme Court; providing procedures
for proceedings; providing for codification; and
providing an effective date.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 91A of Title 51, unless there is
created a duplication in numbering, reads as follows:
A. Members of the Council on Judicial Complaints shall, in
addition to the methods now and causes provided by law, be removed
from office when reasonably sufficient evidence exists that the
Council members failed to properly discipline any person occupying
positions subject to the jurisdiction of the Court on the Judiciary
who is reasonably believed to have committed substantial ethical
violations or violated a criminal law classified as a felony.

B. It shall be the duty of the Attorney General to investigate
any complaint of a violation of subsection A of this section. If on
such investigation the Attorney General shall find that there is
reasonable cause for such complaint, the Attorney General shall
institute proceedings in the Supreme Court to oust such members from
the Council on Judicial Complaints.
C. The procedures for removal of members of the Council on
Judicial Complaints shall be the same as provided in Sections 95
through 105 of Title 51 of the Oklahoma Statutes.
SECTION 2. This act shall become effective November 1, 2026.
