BILL NO. 4046 By: Caldwell (Trey) and Kane of

of the Senate
An Act relating to the military; transferring funds
to the Military Readiness, Innovation, Education, and
Aviation Revolving Fund; identifying sources; stating
purposes; making appropriations; providing for
noncodification; providing effective dates; and
declaring an emergency.
SUBJECT: Military
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law not to be
codified in the Oklahoma Statutes reads as follows:
A. Of the funds appropriated to the Military Department of the
State of Oklahoma in Section 158 of Enrolled House Bill No. 2766 of
the 1st Session of the 60th Oklahoma Legislature, Twenty-one Million
Dollars ($21,000,000.00) or so much as may be necessary shall be
transferred to the Military Readiness, Innovation, Education, and
Aviation Revolving Fund.
B. Of the funds transferred, Six Million Two Hundred Thousand
Dollars ($6,200,000.00) or so much thereof as may be necessary,
shall be for the purpose of constructing or improving common
education facilities on a military base located in Southwest
Oklahoma.
C. Of the funds transferred, Five Million Dollars
($5,000,000.00) or so much thereof as may be necessary, shall be for
the purpose of constructing or improving common education facilities
on a military base located in Northwest Oklahoma.

D. Of the funds transferred, Nine Million Eight Hundred
Thousand Dollars ($9,800,000.00) or so much thereof as may be
necessary, shall be for the purpose of constructing or improving
cargo access to a military facility in Southeast Oklahoma, including
access by rail.
SECTION 2. NEW LAW A new section of law not to be
codified in the Oklahoma Statutes reads as follows:
There is hereby appropriated to the Military Readiness,
Innovation, Education, and Aviation Revolving Fund from any monies
not otherwise appropriated from the Progressing Rural Economic
Prosperity Fund of the State Treasury created in Section 256 of
Title 62 of the Oklahoma Statutes, the sum of Four Million Dollars
($4,000,000.00) for the purpose of constructing or improving cargo
access to a military facility in Southeast Oklahoma, including
access by rail.
SECTION 3. NEW LAW A new section of law not to be
codified in the Oklahoma Statutes reads as follows:
There is hereby appropriated to the Military Readiness,
Innovation, Education, and Aviation Revolving Fund from any monies
not otherwise appropriated from the Progressing Rural Economic
Prosperity Fund of the State Treasury created in Section 256 of
Title 62 of the Oklahoma Statutes, the sum of Ten Million Dollars
($10,000,000.00) for the purpose of constructing a new building
attached to an innovation center that is dedicated to research and
education projects supporting national defense. Such funds shall
not be released until additional funding sources for the project are
obtained and a tenant or tenants are secured.
SECTION 4. NEW LAW A new section of law not to be
codified in the Oklahoma Statutes reads as follows:
The Oklahoma Military Department is hereby authorized to
transfer the balance of the Base Infrastructure Needs and
Development – Schools Revolving Fund, created in Section 301A of
Title 44 of the Oklahoma Statutes, to the Military Readiness,
Innovation, Education, and Aviation Revolving Fund created in
Enrolled House Bill No. 4045 of the 2nd Session of the 60th Oklahoma
Legislature.

SECTION 5. Sections 1 through 3 of this act shall become
effective July 1, 2026.
SECTION 6. It being immediately necessary for the preservation
of the public peace, health or safety, an emergency is hereby
declared to exist, by reason whereof this act shall take effect and
be in full force from and after its passage and approval.
SECTION 7. Section 4 of this act shall become effective October
31, 2026.
