HOUSE BILL 4062 By: Alonso-Sandoval
AS INTRODUCED
An Act relating to food purchasing; creating the
Oklahoma Good Food Purchasing Act; defining terms;
requiring agencies to preference Oklahoma-produced
food when purchasing; providing when agencies may
purchase non-Oklahoma-produced food; granting
agencies discretion in certain instances; allowing
purchases directly from farmers; providing for
creation of certain guideline; granting agencies
certain discretions when selecting a supplier;
requiring submission of a biannual report; providing
report requirements; allowing participation by state
agencies to be phased in; providing for promulgation
of rules; providing for codification; and providing
an effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 12101 of Title 74, unless there
is created a duplication in numbering, reads as follows:
This act shall be known and may be cited as the "Oklahoma Good
Food Purchasing Act".
SECTION 2. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 12102 of Title 74, unless there
is created a duplication in numbering, reads as follows:

As used in this act:
1. "Agricultural products" means food products intended for
human consumption including, but not limited to, fresh produce,
meat, poultry, dairy, grains, processed foods, and seafood;
2. "Good food purchasing" means procurement practices that
strengthen local agricultural and food markets, while prioritizing
food safety, nutritional value, compliance with applicable labor
laws, responsible land and resource use, and supply chain stability;
3. "Oklahoma-produced" means grown, raised, harvested, or
caught within the State of Oklahoma, or processed within the state
using a majority of Oklahoma-grown ingredients when feasible; and
4. "State agency" means any department, agency, board,
commission, or institution of the State of Oklahoma that purchases
food using public funds.
SECTION 3. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 12103 of Title 74, unless there
is created a duplication in numbering, reads as follows:
A. When procuring agricultural products, state agencies shall
give preference to Oklahoma-produced food when such products meet
applicable quality, safety, and availability requirements.
B. When a state agency is presented with a choice between an
Oklahoma-produced product and a comparable product produced outside
the state, the agency shall purchase the Oklahoma-produced product
if the price does not exceed the comparable out-of-state product by

more than ten percent (10%), unless otherwise impracticable due to
supply, timing, or contractual limitations.
C. State agencies shall retain discretion to determine best
value, including consideration of freshness, delivery capacity,
seasonality, vendor reliability, and total lifecycle cost.
SECTION 4. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 12104 of Title 74, unless there
is created a duplication in numbering, reads as follows:
A. State agencies and participating public institutions are
authorized to procure Oklahoma-produced food directly from farmers,
ranchers, food hubs, cooperatives, and other local suppliers,
consistent with state procurement laws.
B. The Office of Management and Enterprise Services (OMES), in
consultation with the Oklahoma Department of Agriculture, Food, and
Forestry and the Oklahoma Conservation Commission, shall adopt
guidelines to facilitate small and mid-sized producer participation
in public procurement.
SECTION 5. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 12105 of Title 74, unless there
is created a duplication in numbering, reads as follows:
State agencies may, at their discretion, give consideration to
suppliers that demonstrate:
1. Compliance with state and federal labor laws;
2. Safe and fair working conditions; and

3. Fair compensation practices for farm and food workers.
SECTION 6. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 12106 of Title 74, unless there
is created a duplication in numbering, reads as follows:
A. The Office of Management and Enterprise Services (OMES)
shall submit a biennial report to the Legislature summarizing:
1. The volume and value of Oklahoma-produced food purchased by
state agencies;
2. Barriers to increased local procurement; and
3. Recommendations for improving program effectiveness.
B. Participation by state agencies may be phased in to ensure
supply stability and cost control.
SECTION 7. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 12107 of Title 74, unless there
is created a duplication in numbering, reads as follows:
The Office of Management and Enterprise Services (OMES) shall
promulgate rules necessary to implement this act.
SECTION 8. This act shall become effective November 1, 2026.
