HOUSE BILL 4277 By: Miller

AS INTRODUCED

An Act relating to school athletics; defining terms;
providing school districts with exclusive control of
school facilities; authorizing a cause of action for
injunctive relief; amending 70 O.S. 2021, Section 8-
103.2, which relates to extramural athletic
competition for transfer students; removing automatic
ineligibility; requiring determination of rule
violation for student to be ineligible; providing for
codification; providing an effective date; and
declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 27-201 of Title 70, unless there
is created a duplication in numbering, reads as follows:
A. As used in this section:
1. "School athletic association" shall have the same meaning as
provided for in Section 27-102 of Title 70 of the Oklahoma Statutes;
2. "School facilities" means any property or building owned and
operated by a public school district including, but not limited to,
athletic fields, gymnasiums, courts, training facilities, practice
facilities, and weight rooms.

B. Notwithstanding any policy of a school athletic association,
a public school district shall have exclusive control over the use
of any school facilities.
C. Any public school district shall have a cause of action for
injunctive relief against any school athletic association that
attempts to limit or control the use of school facilities.
SECTION 2. AMENDATORY 70 O.S. 2021, Section 8-103.2, is
amended to read as follows:
Section 8-103.2. Except as otherwise provided, a A student who
enrolls, pursuant to the Education Open Transfer Act or pursuant to
Section 2 8-113 of this act title, in a school district in which the
student is not a resident shall not be eligible to participate in
school-related extramural athletic competition governed by the
Oklahoma Secondary School Activities Association for a period of one
(1) year from the first day of attendance at the receiving school
unless the transfer is from a school district which does not offer
the grade the student is entitled to pursue. If the student is
granted an emergency transfer pursuant to Section 8-104 of this
title, was granted a transfer for any reason prior to January 1,
2000, or enrolls pursuant to the Education Open Transfer Act and
qualifies for a hardship waiver pursuant to the rules of the
Oklahoma Secondary School Activities Association, eligibility to
participate in school-related extramural athletic competition shall
be determined by the Oklahoma Secondary School Activities

Association unless the student is determined, after a formal due
process hearing, to be ineligible for violation of a specific rule
based on substantial evidence of any governing school athletic
association.
SECTION 3. This act shall become effective July 1, 2026.
SECTION 4. It being immediately necessary for the preservation
of the public peace, health or safety, an emergency is hereby
declared to exist, by reason whereof this act shall take effect and
be in full force from and after its passage and approval.
