HOUSE BILL 4288 By: Fugate

AS INTRODUCED

An Act relating to schools; authorizing the
Department of Mental Health and Substance Abuse
Services to create an alternative education pilot
program for certain suspended students; stating
applicability; providing program requirements;
allowing students to continue the program after
suspension; allowing school district to create a plan
for student reintegration; directing allocation of
available funds; and providing an effective date.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 1210.568a of Title 70, unless
there is created a duplication in numbering, reads as follows:
A. The Department of Mental Health and Substance Abuse Services
is hereby authorized to establish a pilot program to provide
alternative education to students who are suspended out-of-school
for more than fourteen (14) days. The Department shall design the
program in accordance with alternative education program
requirements listed in Section 1210.568 of this title.

B. The program created in subsection A of this section shall
incorporate therapy and other restorative practices into the
student's daily instruction.
C. Students participating in the program shall have the option
to continue the program after their out-of-school suspension
conditions have been met, or their suspension time has expired. In
addition to the education plan for reintegration to core units
required under subsection D of Section 24-101.3 of this title,
school districts may adopt a plan to help students reintegrate into
elective classes, extracurricular activities, and other school
programs when they have completed their out-of-school suspension.
D. Of the funding available for alternative education programs
each fiscal year, the State Department of Education shall designate
up to ten percent (10%) for the program established in subsection A
of this section based on student participation.
SECTION 2. This act shall become effective November 1, 2026.
