BILL NO. 4358 By: Moore, Archer, Hall, Lowe,
and Caldwell (Chad) of the
House
and
Seifried of the Senate
An Act relating to schools; limiting screen time for
prekindergarten through fifth-grade public school
students to one hour per school day; defining term;
providing exceptions; providing for codification;
providing an effective date; and declaring an
emergency.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 11-103.17 of Title 70, unless
there is created a duplication in numbering, reads as follows:
A. Beginning with the 2026-2027 school year, public school
students in prekindergarten through fifth grade shall be limited to
one (1) hour of screen time per school day, inclusive of all
subjects. Screen time includes teacher-directed or child-selected
activities that utilize a computer, tablet, television, smart
device, Chromebook, or other similar device with an electronic
display.

B. The screentime limitations set forth in subsection A of this
section shall not apply to the following:
1. Targeted instructional support, intervention, or
remediation;
2. Accommodations or services, including the use of assistive
technology, required under the Individuals with Disabilities
Education Act, 20 U.S.C., Section 1400 et seq., Section 504 of the
Rehabilitation Act of 1973, 29 U.S.C., Section 794, or the Americans
with Disabilities Act, 42 U.S.C., Section 12101 et seq.;
3. Administration of a screening instrument adopted by the
State Board of Education pursuant to Section 1210.508C of this
title, dyslexia screenings, state-adopted benchmark assessments, or
other assessments required by state or federal law;
4. Teacher preparation, lesson planning, and professional use;
5. Digital textbooks, smart boards, or other similar devices
used specifically to display classroom curriculum;
6. Computer programming classes; and
7. Public virtual schools.
SECTION 2. This act shall become effective July 1, 2026.
SECTION 3. It being immediately necessary for the preservation
of the public peace, health or safety, an emergency is hereby
declared to exist, by reason whereof this act shall take effect and
be in full force from and after its passage and approval.
