An Act relating to economic development; making
findings; defining terms; establishing program within
the Oklahoma Film + Music Office; stating purpose of
program; creating tracks within program; describing
program tracks; prescribing required expenditure and
cost amounts; authorizing use of program funds;
prescribing authorized use of funds; providing for
state contribution percentages; providing for
priority of certain applications related to
population; providing for collaboration with Oklahoma
Department of Career and Technology Education;
requiring annual reports; creating the Community
Music Infrastructure and Events Development Revolving
Fund; providing for authorized revenue sources;
providing for expenditures from fund; providing for
codification; and providing an effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2236-1 of Title 74, unless there
is created a duplication in numbering, reads as follows:
The purpose of this act shall be to establish a comprehensive
program that supports both permanent music infrastructure and
community-based music festivals.

SECTION 2. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2236-2 of Title 74, unless there
is created a duplication in numbering, reads as follows:
The Legislature finds:
1. Music venues, rehearsal facilities, cultural districts, and
event spaces are essential components of Oklahoma's economy and
support the development of small businesses and skilled technical
workers;
2. Locally produced music festivals activate communities,
stimulate tourism, enhance economic vitality, and promote Oklahoma
as a destination for music;
3. Many Oklahoma communities lack year-round music
infrastructure necessary to support sustainable programming; and
4. Strengthening music infrastructure and festival capacity
will improve workforce readiness in sound engineering, lighting,
stage production, safety, hospitality, and event management.
SECTION 3. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2236-3 of Title 74, unless there
is created a duplication in numbering, reads as follows:
As used in this act:
1. "Community music infrastructure" means permanent or semi-
permanent facilities, structures, equipment, or improvements that
support music performance, rehearsal, or community music activity;

2. "Eligible applicant" includes municipalities, counties,
tribal nations, nonprofit organizations, Main Street programs, arts
councils, or privately operated venues or festival organizations
partnered with a nonprofit or public entity;
3. "Festival" or "music festival" means a community-organized
musical event presented over one (1) or more consecutive days that
includes live music components and is open to the public;
4. "Main Street community" means any community participating in
the Oklahoma Main Street Program administered by Oklahoma Main
Street within the Department of Commerce;
5. "Music venue" means an independently operated facility that
hosts live music performances on a regular basis;
6. "Office" means the Oklahoma Film + Music Office (OF+MO)
within the Department of Commerce;
7. "Rehearsal space" means any facility that may be
acoustically treated, used for music creation, practice, or
education available to the public; and
8. "Rural community" means a city or town having a population
not in excess of twenty-five thousand (25,000) persons or county not
in excess of two hundred fifty thousand (250,000) persons.
SECTION 4. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2236-4 of Title 74, unless there
is created a duplication in numbering, reads as follows:

A. The Community Music Infrastructure and Events Development
Program is hereby established within the Oklahoma Film + Music
Office.
B. The purpose of the program is to:
1. Develop, expand, and preserve year-round community music
infrastructure;
2. Support community-produced music festivals;
3. Improve workforce development opportunities through
partnerships with educational institutions and Oklahoma CareerTech;
4. Activate public spaces, Main Street districts, and tourism
destinations through music; and
5. Expand performance opportunities for Oklahoma musicians.
SECTION 5. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2236-5 of Title 74, unless there
is created a duplication in numbering, reads as follows:
A. The Community Music Infrastructure Program shall consist of
two tracks as follows:
1. Track A: Community Music Infrastructure Awards
For Track A, the Office shall ensure projects are capital-
worthy, not cosmetic and shall exclude from consideration projects
that should be handled privately.
For Track A, the Office shall also confirm construction or
renovation costs, permanent equipment, (sound, lighting, staging),

Americans with Disabilities Act compliance and safety upgrades and
the use of professional labor and materials.
2. Track B: Community Music Festivals
For Track B, the Office shall confirm that the event has market
viability to prevent funding of small, informal gatherings, and to
ensure that the minimum festival budget is in alignment with the
concept of a twenty-percent award.
The Office shall verify artist fees, production and staging
costs, security costs, logistics and permitting, market and
promotion, workforce or Higher Education/CareerTech engagement.
B. Awards pursuant to the provisions of this section may be
used for, but not limited to:
1. Capital improvements to music venues or community
facilities;
2. Electrical, plumbing, HVAC, or structural upgrades;
3. ADA accessibility improvements;
4. Safety and compliance measures, including fire suppression
and crowd-management systems;
5. Soundproofing and acoustic treatment;
6. Permanent staging, lighting, or audiovisual systems;
7. Conversion of public or underutilized buildings into music-
use facilities;
8. Rehearsal space creation or enhancement;

9. Permanent equipment inventory to be shared by community
festivals or venues; and
10. Infrastructure improvements in parks, Main Street
districts, or tourism areas.
SECTION 6. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2236-6 of Title 74, unless there
is created a duplication in numbering, reads as follows:
Track B — Community Music Festivals Awards
Awards pursuant to the provisions of this section may be used
for, but not limited to:
1. Development or expansion of community music festivals;
2. Temporary festival infrastructure that complements permanent
assets;
3. Workforce training in partnership with CareerTech or Higher
Education (audio, lighting, staging, event management);
4. Festival safety planning, ADA accommodations, and
accessibility improvements;
5. Event equipment rentals or site preparation; and
6. Artists, directors, managers, crew, and staff.
SECTION 7. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2236-7 of Title 74, unless there
is created a duplication in numbering, reads as follows:
The revenue to the Community Music Infrastructure and Events
Development Revolving Fund pursuant to Section 2352 of Title 68 of
ENGR. H. B. NO. 4476 Page 7

the Oklahoma Statutes shall be allocated by the Oklahoma Film +
Music Office as follows each fiscal year:
1. Track A (Infrastructure): sixty percent (60%) of fund; and
2. Track B (Festivals/Events): forty percent (40%) of fund.
SECTION 8. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2236-8 of Title 74, unless there
is created a duplication in numbering, reads as follows:
A. Applications from rural communities shall receive priority
consideration.
B. Projects located within or benefiting an Oklahoma Main
Street district shall receive enhanced scoring.
C. Existing music festivals shall receive priority
consideration.
SECTION 9. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2236-9 of Title 74, unless there
is created a duplication in numbering, reads as follows:
The Office and the applicant shall collaborate with Oklahoma
CareerTech or Higher Education to develop and deliver workforce
training aligned with, but not limited to:
1. Audio engineering;
2. Lighting design;
3. Stagecraft and rigging;
4. Event operations;
5. Hospitality and tourism services; and

SECTION 10. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2236-10 of Title 74, unless
there is created a duplication in numbering, reads as follows:
The Office shall submit an annual report to the Governor,
President Pro Tempore of the Oklahoma State Senate, and Speaker of
the Oklahoma House of Representatives that includes:
1. Number, type, and location of funded projects;
2. Infrastructure improvements completed;
3. Festivals or events activated;
4. Economic impact metrics;
5. Workforce development outcomes; and
6. Participation of Oklahoma musicians and vendors.
SECTION 11. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2236-11 of Title 74, unless
there is created a duplication in numbering, reads as follows:
The Oklahoma Film + Music Office is authorized to:
1. Develop rules, scoring criteria, and evaluation processes;
2. Establish award cycles and reporting requirements; and
3. Adopt rules necessary for implementation of this act
pursuant to the Administrative Procedures Act.
SECTION 12. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2236-12 of Title 74, unless
there is created a duplication in numbering, reads as follows:

There is hereby created in the State Treasury a revolving fund
for the Oklahoma Tax Commission to be designated the "Community
Music Infrastructure and Events Development Revolving Fund". The
fund shall be a continuing fund, not subject to fiscal year
limitations, and shall consist of all monies received by the
Oklahoma Tax Commission which are specifically required by law to be
deposited in the fund, any public or private donations,
contributions and gifts received for the benefit of the fund, and
any amounts appropriated by the Oklahoma Legislature. All monies
accruing to the credit of said fund are hereby appropriated and may
be budgeted and expended by the Oklahoma Tax Commission for the
purpose of paying rebates as provided in this act. Expenditures
from said fund shall be made upon warrants issued by the State
Treasurer against claims filed as prescribed by law with the
Director of the Office of Management and Enterprise Services for
approval and payment. Awards are less than the limitation provided,
the excess rebate payments not utilized shall be added to subsequent
fiscal year's limitations.
SECTION 13. This act shall become effective November 1, 2026.
