RESOLUTION NO. 1007 By: Sneed and Adams of the

of the Senate
A Concurrent Resolution relating to rural health
care; and providing for exemption from Stark Law.
WHEREAS, the State of Oklahoma has a health care shortage, in
particular in the rural parts of the state; and
WHEREAS, the State of Oklahoma wants to support and protect the
rural health care community and medical care provided in those
areas; and
WHEREAS, the Physician Self-Referral Law or Stark Law, 42
U.S.C., Section 1395nn, within the Social Security Act of the United
States Code, is an impediment to the rural health care community and
medical care.
NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES
OF THE 1ST SESSION OF THE 60TH OKLAHOMA LEGISLATURE, THE SENATE
CONCURRING THEREIN:

THAT the State of Oklahoma be exempt from the provisions of the
Stark Law, 42 U.S.C., Section 1395nn, which adversely impact the
delivery of essential medical care in rural areas of the state.
THAT the State of Oklahoma be exempt from any administrative
rule adopted pursuant to the authority of the Stark Law, 42 U.S.C.,
Section 1395nn, which adversely impacts the delivery of essential
medical care in rural areas of the state.
