JOINT
RESOLUTION NO. 1035 By: Kendrix of the House
and
Bergstrom of the Senate
A Joint Resolution approving certain proposed
permanent rules of health-related state agencies;
disapproving certain proposed permanent rules of the
Oklahoma Funeral Board, Board of Chiropractic
Examiners, Health Care Authority, and Department of
Mental Health and Substance Abuse Services; and
directing distribution.
SUBJECT: Proposed permanent rules
WHEREAS, pursuant to Section 308.3 of Title 75 of the Oklahoma
Statutes, the Oklahoma State Legislature shall have a joint
resolution prepared for consideration each session.
NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES
AND THE SENATE OF THE 1ST SESSION OF THE 60TH OKLAHOMA LEGISLATURE:
SECTION 1. All proposed permanent rules of the Commission on
Children and Youth, the State Department of Health, the Department
of Human Services, State Board of Medical Licensure and Supervision,
the Board of Medicolegal Investigations, the State Board of
Osteopathic Examiners, State Board of Examiners of Perfusionists,
Health Care Workforce Training Commission, and the Oklahoma Workers'
Compensation Commission filed on or before February 1, 2025, are
hereby approved.
SECTION 2. All proposed permanent rules of the Oklahoma Funeral
Board filed on or before February 1, 2025, are hereby approved,
except for the proposed changes to paragraph (6) of OAC 235:10-3-2,

the proposed changes in the entirety of OAC 235:10-3-4, and the
proposed changes in paragraphs (c) and (e) of OAC 235:10-14-1.
SECTION 3. All proposed permanent rules of the Oklahoma Board
of Chiropractic Examiners filed on or before February 1, 2025, are
hereby approved, except for the proposed changes in OAC 140:15-5-5.
SECTION 4. All proposed permanent rules of the Oklahoma Health
Care Authority filed on or before February 1, 2025, are hereby
approved, except for the proposed changes in division (GG) of
subparagraph (1) of paragraph (a) of OAC 317:30-5-2.
SECTION 5. All proposed permanent rules of the Department of
Mental Health and Substance Abuse Services filed on or before
February 1, 2025, are hereby approved, except for: the proposed
changes to the "diversion control plan" and "medical director"
definitions of OAC 450:70-1-2; the proposed changes to subparagraphs
(2), (4), (6), and (9) of paragraph (a) of OAC 450:70-4-8.3; the
proposed changes to subparagraph (3) of paragraph (c) of OAC 450:70-
6-10; and the proposed changes to paragraph (b) of OAC 450:70-6-
17.2.
SECTION 6. The Oklahoma Secretary of State is hereby directed
to distribute copies of this resolution to the Governor and the
editor of "The Oklahoma Register".
