HOUSE JOINT
RESOLUTION 1036 By: Steagall

AS INTRODUCED

A Joint Resolution relating to Article V of the
United States Constitution; making application to
Congress; and providing for distribution.

NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES
AND THE SENATE OF THE 2ND SESSION OF THE 60TH OKLAHOMA LEGISLATURE:
SECTION 1. The Legislature of the State of Oklahoma hereby
makes an application to Congress, as provided by Article V of the
Constitution of the United States of America, to call a convention
limited to proposing an amendment to the Constitution of the United
States of America which would prohibit any payment of compensation
to the President of the United States of America, to any elected
member of the United States House of Representatives, to any elected
member of the United States Senate, and to any appointed Justice of
the Supreme Court for periods during which a government shutdown is
in effect. For purposes of this section, a government shutdown
shall be considered to be in effect any time there is a lapse in

appropriations for any federal agency or department as a result of a
failure to annually enact a balanced budget or continuing
resolution.
SECTION 2. Failure to annually enact a balanced budget shall
render the President of the United States of America, all elected
members of the United States House of Representatives, and all
elected members of the United States Senate ineligible for re-
election the following term. For purposes of this section, a
balanced budget, not to exceed the collected tax revenue from the
previous tax year, shall be enacted no later than the last Thursday
of March each year, applicable for the following fiscal year.
The United States Congress shall enforce this article through
appropriate legislation.
