HOUSE JOINT
RESOLUTION 1062 By: Humphrey
AS INTRODUCED
A Joint Resolution directing the Secretary of State
to refer to the people for their approval or
rejection the repeal of Sections 3 and 4 of Article
XXIX of the Constitution of the State of Oklahoma;
removing certain duties and powers of the Ethics
Commission; providing ballot title; and directing
filing.
BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE
OF THE 2ND SESSION OF THE 60TH OKLAHOMA LEGISLATURE:
SECTION 1. The Secretary of State shall refer to the people for
their approval or rejection, as and in the manner provided by law,
the repeal of Section 3 of Article XXIX of the Constitution of the
State of Oklahoma which relates to the creation of ethics rules and
penalties.
SECTION 2. The Secretary of State shall refer to the people for
their approval or rejection, as and in the manner provided by law,
the repeal of Section 4 of Article XXIX of the Constitution of the
State of Oklahoma which relates to investigations, decisions, and
subpoena powers of the Ethics Commission.

SECTION 3. The Ballot Title for the proposed Constitutional
repeal as set forth in SECTIONS 1 and 2 of this resolution shall be
in the following form:

THE GIST OF THE PROPOSITION IS AS FOLLOWS:
This measure repeals Sections 3 and 4 of Article 29 of the
Oklahoma Constitution. Section 3 requires the Oklahoma Ethics
Commission to create rules for ethical behavior. These rules
apply to state election campaigns, state officers, and state
employees. Section 3 also explains how these rules take
effect, how they may be changed, and how penalties may be set.
Section 4 gives the Ethics Commission the power to investigate
possible ethics violations. It also allows the Commission to
bring cases in district court, settle cases, collect fines, and
use subpoenas during investigations. If this measure is
approved, these two sections would be removed from the Oklahoma
Constitution. The Ethics Commission would no longer have these
powers or duties under Sections 3 and 4 of Article 29 of the
Oklahoma Constitution.

SECTION 4. The Chief Clerk of the House of Representatives,
immediately after the passage of this resolution, shall prepare and
file one copy thereof, including the Ballot Title set forth in
SECTION 3 hereof, with the Secretary of State and one copy with the
Attorney General.
