RESOLUTION NO. 1069 By: Lawson of the House
and
Thompson of the Senate
A Joint Resolution directing the Secretary of State
to refer to the people for their approval or
rejection proposed amendments to Sections 4 and 8 of
Article XVII of the Constitution of the State of
Oklahoma; modifying procedure for the Legislature to
create or alter counties and the equitable division
of assets and liabilities; providing updated legal
descriptions of counties; providing ballot title; and
directing filing.
BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE
OF THE 2ND SESSION OF THE 60TH OKLAHOMA LEGISLATURE:
SECTION 1. The Secretary of State shall refer to the people for
their approval or rejection, as and in the manner provided by law,
the following proposed amendment to Section 4 of Article XVII of the
Constitution of the State of Oklahoma to read as follows:
Section 4. The Legislature shall provide by general laws for
the creation of new counties or altering or changing lines and the
equitable division of assets and of liabilities, and the original
location of county seats in such new counties: Provided, That every
such question shall be submitted to the vote of the qualified

electors residing in the territory to be formed into such new county
or transferred to another county, and shall be approved by sixty per
centum of the votes cast in said election: Provided, That no new
county shall be formed of less than four hundred square miles
taxable area, nor with a population less than fifteen thousand
people, nor with taxable wealth less than two and one-half million
dollars, as shown by the current tax rolls. Nor shall any territory
be taken from an existing county for any purpose bringing the newly
created line of such existing county nearer than ten miles to the
county seat thereof. Nor shall the taxable area, population, or
taxable wealth of said existing county be reduced below that
required for a new county. Nor shall any territory, in any case, be
transferred from one county to an existing county, if, by such
transfer of territory, the county from which the territory be taken
will then be smaller in area than the county to which the addition
is made: Provided, That when territory is to be transferred from an
existing county to either a new or an existing county, there must be
sixty per centum of the vote cast in such particular territory in
favor of the transfer, and, in case the transfer be to an existing
county, the acceptance of such territory must first be approved by a
majority vote of the electors of said county, at an election to be
called and held therefor, as may be provided by law. The limitation
as to area, valuation and population shall not be increased by the
Legislature.

Constitution of the State of Oklahoma to read as follows:
Section 8. The State of Oklahoma is hereby divided into
Counties named and described as follows (all descriptions are
referred to the Indian Meridian and base line established by the
United States Geological Survey, 1895-1899; unless otherwise
specifically mentioned). Detailed Public Land Survey System (PLSS)
descriptions are referenced to the Bureau of Land Management (BLM)
New Mexico CADNSDI PLSS Township, First Division (Sections) and
Second Division (Section subdivisions and government lots)
Geographic Information System (GIS) vector digital data layers,
Version 2, published December 13, 2023:
Adair County: Beginning on the township line between townships
nineteen and twenty North, at its intersection with the range line
between ranges twenty-three and twenty-four East; thence east along

amendment as set forth in SECTIONS 1 and 2 of this resolution shall

THE GIST OF THE PROPOSITION IS AS FOLLOWS:
This measure amends the Oklahoma Constitution in Sections 4 and
8 of Article 17. This measure updates the provisions related
to the creation of new counties and changes to county
boundaries. This measure would still allow the Legislature to
pass general laws governing the creation of new counties,
changes to county lines, the fair division of county assets and
debts, and the original location of county seats. All other
requirements including voting requirements to form a county or
transfer territory and minimum requirements for land area,
population size, and taxable property value which are currently
listed in the Constitution would be stricken. These
requirements would still be governed by statutes passed by the
Legislature. This measure also provides updated legal
descriptions of all seventy-seven counties.
