SENATE BILL 121 By: Burns
AS INTRODUCED
An Act relating to state parks; transferring the Hugo
Lake Park to the Oklahoma Tourism and Recreation
Department; authorizing Department to establish funds
and accounts for the servicing of fiscal operations
of the state park; exempting the Department from
certain tort claims arising or accruing prior to
certain date; providing for succession related to
contraction rights, rents, obligations, and
responsibilities; providing for promulgation of rules
for the transfer; providing for codification; and
providing an effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 2229.1C of Title 74, unless
there is created a duplication in numbering, reads as follows:
A. By January 1, 2026, all properties held in fee title, lease
or otherwise, including interests in land, real estate options, or
real estate contracts designated for Hugo Lake Park are hereby
transferred to the Oklahoma Tourism and Recreation Department.

B. Appropriate conveyances and other documents shall be
executed by January 1, 2026, to effectuate the transfer of Hugo Lake
Park.
C. The Department shall establish appropriate funds and
accounts, including a revolving fund in the Office of Management and
Enterprise Services, for servicing the fiscal operations of the
park. Such funds and accounts shall be subject to the direct
supervision, management, and control of the Department.
D. The Department shall not be responsible for any claims
arising under The Governmental Tort Claims Act accrued prior to
January 1, 2026, claims arising from any other actions accrued prior
to January 1, 2026, or tort claims arising prior to January 1, 2026,
for which no claim has accrued upon the date of transfer. The
Department shall not be responsible for any claims arising out of
construction begun before January 1, 2026, at Hugo Lake Park.
E. 1. The Department shall succeed to any contractual rights
and responsibilities of the previous operators of Hugo Lake Park,
including but not limited to:
a. any responsibilities for payment of rents or other
obligations, and
b. any responsibilities related to contractual agreements
with nonprofit organizations.
2. The Department may enter into one or more contracts for
management services of the state park. The duties and benefits

arising under any contract for management services of any part of
the previous operators that is in effect on January 1, 2026, shall
be assigned to the Department. The contract may be renewable at the
option of the Department but not to exceed a cumulative period of
fifty (50) years.
F. The Department shall promulgate the rules necessary for the
transfer of property from Hugo Lake Park to the Oklahoma state park
system.
SECTION 2. This act shall become effective November 1, 2025.
