An Act relating to notaries public; amending 49 O.S.
2021, Section 6.1, which relates to provision of
legal advice; modifying allowable punishment;
updating statutory references; and providing an
effective date.

SUBJECT: Notaries public

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

SECTION 1. AMENDATORY 49 O.S. 2021, Section 6.1, is
amended to read as follows:

Section 6.1. Any individual convicted of violating subsection B
of Section 6 of Title 49 of the Oklahoma Statutes this title shall
be guilty of a misdemeanor and shall be subject to a fine not to
exceed One Thousand Dollars ($1,000.00), imprisonment in the county
jail for up to one (1) year, or both such fine and imprisonment.
Upon receipt of a final judgment against a notary public for a
violation of subsection B of Section 6 of Title 49 of the Oklahoma
Statutes this title from a district court of this state or its
equivalent from a foreign jurisdiction, the Secretary of State shall
revoke the appointment of the notary for a period of eight (8)
years.

SECTION 2. This act shall become effective November 1, 2026.
