SENATE BILL 1288 By: Gillespie

AS INTRODUCED

An Act relating to emergency management; amending 63
O.S. 2021, Section 683.24, which relates to the
Emergency Management Disaster Relief Matching Fund;
providing for cost sharing of federal matching
requirements; updating statutory language; and
declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. AMENDATORY 63 O.S. 2021, Section 683.24, is
amended to read as follows:
Section 683.24. A. There is hereby created in the State
Treasury a special fund for the Oklahoma Department of Emergency
Management, to be designated the Emergency Management Disaster
Relief Matching Fund. The fund shall be a continuing fund not
subject to fiscal year limitations, and shall be composed of monies
that may be appropriated to or otherwise received by said the fund.
Said The fund is to be utilized as the state’s share of matching
requirements for federal funds advanced under the provisions of
Sections 402, 403 and 419, Public Law 93-288, Disaster Relief Act of
1974 and shall not be subject to legislative appropriation.

B. The state’s share of matching requirements for federal funds
shall be equally shared by this state and any political subdivisions
of this state that receive public assistance program resources
administered by the Federal Emergency Management Agency as a result
of a federally declared disaster.
SECTION 2. It being immediately necessary for the preservation
of the public peace, health or safety, an emergency is hereby
declared to exist, by reason whereof this act shall take effect and
be in full force from and after its passage and approval.
