SENATE BILL NO. 1329 By: Hicks of the Senate

and

Archer of the House

An Act relating to the state Medicaid program;
defining term; requiring Medicaid providers to
conduct certain screening; providing for
reimbursement; requiring the Oklahoma Health Care
Authority to seek certain federal approval; directing
promulgation of rules; providing for codification;
and providing an effective date.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 5029.2 of Title 63, unless there
is created a duplication in numbering, reads as follows:
A. As used in this section, “postpartum period” means the
period beginning when a woman gives birth and ending one (1) year
after the woman gives birth.
B. A health care provider participating in the state Medicaid
program who conducts a visit with a woman who is a Medicaid member
or her infant during the postpartum period shall conduct a mental

health screening of the woman to check for signs of postpartum
depression.
C. The screening described in subsection B of this section
shall be reimbursable under the state Medicaid program.
D. 1. The Oklahoma Health Care Authority shall seek any
federal approval necessary to implement the provisions of this
section.
2. The Oklahoma Health Care Authority Board shall promulgate
rules as necessary to implement the provisions of this section.
SECTION 2. This act shall become effective November 1, 2026.
