SENATE BILL 1522 By: Dossett
AS INTRODUCED
An Act relating to firearms; defining terms;
authorizing certain agreements; providing immunity
from civil liability for licensed dealers under
certain circumstances; providing exceptions;
providing for codification; and providing an
effective date.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 1289.32 of Title 21, unless
there is created a duplication in numbering, reads as follows:
A. For the purposes of this section:
1. “Firearm hold agreement” means a written or oral agreement
between an owner of a firearm and a licensed dealer in which a
licensed dealer takes possession of the owner’s firearm at the
request of the owner and returns the firearm to the owner according
to the terms of the agreement; and
2. “Licensed dealer” shall have the same meaning as provided in
subsection A of Section 1289.28 of Title 21 of the Oklahoma
Statutes.

B. A licensed dealer may enter into a firearm hold agreement
with a firearm owner to hold or store a firearm for the firearm
owner.
C. Except as provided for in subsection D of this section, a
licensed dealer who takes physical possession of a lawfully
possessed firearm pursuant to a firearm hold agreement is immune
from civil liability for any act or omission arising from taking
possession of the firearm, storing the firearm, or returning the
firearm to the firearm owner pursuant to the terms of a firearm hold
agreement. This shall include, but not be limited to, any personal
injury or death that occurs after the return of a firearm to the
owner of the firearm at the termination of the firearm hold
agreement.
D. A licensed dealer is not immune from civil liability
pursuant to this section if:
1. An action arising from a firearm hold agreement was the
result of gross negligence or reckless or unlawful conduct on the
part of the licensed dealer; or
2. The licensed dealer knew at the time the firearm owner
sought to retrieve his or her firearm pursuant to a firearm hold
agreement that the firearm owner was:
a. demonstrating behavior that he or she would engage in
unlawful use of the firearm,

b. demonstrating behavior that he or she would cause harm
to himself or herself or another person, or
c. prohibited from owning or possessing a firearm.
SECTION 2. This act shall become effective November 1, 2026.
