AS INTRODUCED

An Act relating to tort liability; defining terms;
prohibiting liability of off-road motorcycle entities
for injury caused by certain activities; providing
certain exceptions; providing for codification; and
providing an effective date.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 56 of Title 76, unless there is
created a duplication in numbering, reads as follows:
A. As defined in this act:
1. “Off-road motorcycle” means the same as defined in Section
1102 of Title 47 of the Oklahoma Statutes;
2. “Off-road motorcycle area” means a commercial property
designed to provide recreation or education related to driving an
off-road motorcycle on unpaved roads or surfaces including, but not
limited to, driving instruction, practices, competitions, or
performances, or group driving activities including, but not limited
to, tours, hunts, or races; and

3. “Off-road motorcycle entity” means an individual or entity,
including, but not limited to, an employee or volunteer who is:
a. engaged in the business of owning, operating, or
leasing an off-road motorcycle area, or
b. sponsoring, sanctioning, endorsing, or officiating an
off-road motorcycle area.
B. Except as provided in subsection C of this section, an
owner, employee, participant, member, guest, or customer of an off-
road motorcycle entity who is acting in good faith and pursuant to
the standards of the off-road motorcycle industry shall not be
liable for injuries to any person engaged in off-road motorcycle
activities when such injuries result from the inherent risks of such
activities.
C. 1. The provisions of this section shall not apply to
employees in the performance of their duties who are covered by or
subject to the provisions of the Administrative Workers’
Compensation Act.
2. Nothing in subsection B of this section shall prevent or
limit the liability of an owner, employee, participant, member, or
customer, if such person:
a. commits an act or omission that constitutes willful or
wanton disregard for the safety of any person engaged
in off-road motorcycle activities, and that act or
omission caused the injury, or

b. intentionally injures a person engaged in off-road
motorcycle activities.
SECTION 2. This act shall become effective November 1, 2026.
