An Act relating to sex offenders; requiring law
enforcement officers to submit a report or complaint
for official investigation to the Oklahoma State
Bureau of Investigation in certain circumstances;
requiring confidentiality of reports or complaints
for official investigation; providing exceptions;
providing for codification; and providing an
effective date.

SUBJECT: Reports of sex offense complaints

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 40.3B of Title 22, unless there
is created a duplication in numbering, reads as follows:

A. Upon receipt of a report, complaint, or allegation of an
offense which, if convicted, would result in the defendant being
required to register as a sex offender pursuant to Section 582 of
Title 57 of the Oklahoma Statutes, whether originating from a
citizen report, third-party complaint, arrest, or other means, the
law enforcement officer who takes the report or initiates the
complaint shall, within one (1) month, submit to the Oklahoma State
Bureau of Investigation a record of the report or complaint for
official investigative and recordkeeping purposes. The record shall
include, to the extent known or available at the time of the report,
the name or identifying information of the accused, the nature of

the alleged offense, the date, time, and location of the alleged
offense, and the agency report number.

B. The duty to submit information pursuant to this section
shall apply regardless of whether an arrest is made or whether
criminal charges are subsequently filed.

C. Information submitted to the Bureau pursuant to this section
shall not be made available for public inspection and shall remain
confidential except as authorized by law for official investigative
or prosecutorial purposes.

SECTION 2. This act shall become effective November 1, 2026.
