SENATE BILL 1890 By: Murdock

AS INTRODUCED

An Act relating to school activities; creating the
Oklahoma Athletics and Activities Commission;
providing for appointment of members; requiring
initial appointments to be made by certain date;
providing for terms of members; requiring
organizational meeting to be held by certain date;
providing for election of chair and vice chair;
providing term limit for chair; allowing members to
be removed for cause; providing for filling of
vacancies; prohibiting members of the Legislature
from being appointed while serving and for certain
time period thereafter; providing frequency of
meetings; allowing special meetings to be called;
providing for quorum; providing for travel
reimbursement; subjecting the Commission to certain
acts; directing the State Department of Education to
provide office space; providing duties of the
Commission; directing the Commission to supervise and
organize certain activities beginning in certain
school year; repealing 70 O.S. 2021, Section 8-103.2,
which relates to participation in certain
competitions after certain transfer; providing for
codification; providing an effective date; and
declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 27-500 of Title 70, unless there
is created a duplication in numbering, reads as follows:

A. There is hereby created the Oklahoma Athletics and
Activities Commission to provide supervision, coordination, and
regulation for secondary school activities in this state.
B. The Commission shall be comprised of:
1. Three public school district administrators or athletic
directors employed by districts with an average daily membership
(ADM) of one thousand five hundred (1,500) students or more,
appointed by the Governor, the President Pro Tempore of the Senate,
and the Speaker of the House of Representatives;
2. Three public school district administrators or athletic
directors employed by districts with an ADM of less than one
thousand five hundred (1,500) students, appointed by the Governor,
the President Pro Tempore of the Senate, and the Speaker of the
House of Representatives;
3. Three parents or legal guardians of students enrolled in
public school districts with an ADM of seven hundred fifty (750)
students or more, appointed by the Governor, the President Pro
Tempore of the Senate, and the Speaker of the House of
Representatives;
4. Three parents or legal guardians of students enrolled in
public school districts with an ADM of less than seven hundred fifty
(750) students, appointed by the Governor, the President Pro Tempore
of the Senate, and the Speaker of the House of Representatives;

5. Three parents or legal guardians of students enrolled in
private schools in this state with an enrollment of three hundred
(300) students or more, appointed by the Governor, the President Pro
Tempore of the Senate, and the Speaker of the House of
Representatives;
6. Three parents or legal guardians of students enrolled in
private schools in this state with an enrollment of fewer than three
hundred (300) students, appointed by the Governor, the President Pro
Tempore of the Senate, and the Speaker of the House of
Representatives; and
7. The Superintendent of Public Instruction or his or her
designee.
C. 1. Initial appointments shall be made by August 1, 2026.
The Governor, the President Pro Tempore of the Senate, and the
Speaker of the House of Representatives shall each appoint one
member for three (3) years, one member for four (4) years, and one
member for five (5) years. Members shall serve until a successor is
appointed.
2. The Commission shall have an organizational meeting by
September 1, 2026, during which members shall elect from its
membership a chair and vice chair. The Commission shall elect from
its membership a chair and vice chair by November 30 every two (2)
years thereafter. No member shall serve more than two consecutive
terms as chair.

3. Members may be removed from the Commission by the appointing
authority for cause. Vacancies shall be filled by the appointing
authority for the unexpired term.
D. No member of the Senate or the House of Representatives may
be appointed to the Commission while serving as a member of the
Legislature or for two (2) years following the expiration of the
term of office.
E. The Commission shall meet once each month. Special meetings
may be called by the chair or by a majority of the members of the
Commission. Ten members of the Commission shall constitute a
quorum. No business may be transacted at any meeting unless a
quorum is present in person or through teleconferencing, and every
act of the Commission shall be approved by a majority of the
membership of the Commission. Each member of the Commission shall
receive necessary traveling expenses while in the performance of
duties as a member pursuant to the State Travel Reimbursement Act.
F. The Commission shall be subject to the Oklahoma Open Meeting
Act and the Oklahoma Open Records Act.
G. The State Department of Education shall provide office space
for the operation of the Commission.
SECTION 2. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 27-501 of Title 70, unless there
is created a duplication in numbering, reads as follows:

A. The Oklahoma Athletics and Activities Commission created
pursuant to Section 1 of this act shall have supervision of the
secondary school activities in this state. Subject to limitations
otherwise provided by law, the Commission shall:
1. Promulgate rules pursuant to the Administrative Procedures
Act for the operation, supervision, and regulation of secondary
school activities. The rules shall, at a minimum, address
eligibility for student participation, usage of athletic facilities,
student recruitment, a code of conduct, and disciplinary procedures
for violations of the code of conduct;
2. Hire and fix the compensation and duties of an Executive
Director and other personnel required to carry out the duties of the
Commission;
3. Have the authority to enter into agreements with private
schools for their inclusion in secondary school activities
coordinated by the Commission;
4. Have the authority to cooperate with and enter into
agreements with national athletic associations as may be necessary
to promote, organize, or regulate secondary school activities;
5. Develop a plan to operate, supervise, and regulate secondary
school activities for all public and private schools in this state.
The plan shall be electronically submitted to the Governor, the
President Pro Tempore of the Senate, and the Speaker of the House of
Representatives by January 30, 2027;

6. Purchase or acquire equipment, materials, supplies, and
other property, real or personal, as may be necessary for the
operation of the Commission;
7. Enter into agreements and contracts as necessary with the
State Department of Education, boards of education of public school
districts, and governing boards of private schools;
8. Set fees for public and private school membership and
activity participation; and
9. Enter into cooperative agreements with one or more other
states for the coordination and administration of programs,
services, activities, and competitions.
B. Beginning with the 2027-2028 school year, the Oklahoma
Athletics and Activities Commission created pursuant to Section 1 of
this act shall supervise and organize all secondary school
activities for public and private schools that enter into agreements
with the Commission including, but not limited to, categorization of
schools, scheduling of all regular season secondary school activity
competitions, scheduling of all post-season competitions, hiring and
training secondary school activity officials, and athletic facility
usage.
SECTION 3. REPEALER 70 O.S. 2021, Section 8-103.2, is
hereby repealed.
SECTION 4. This act shall become effective July 1, 2026.

SECTION 5. It being immediately necessary for the preservation
of the public peace, health, or safety, an emergency is hereby
declared to exist, by reason whereof this act shall take effect and
be in full force from and after its passage and approval.
