SENATE BILL 1917 By: Bullard
AS INTRODUCED
An Act relating to solar energy devices; defining
term; stating permissible locations for installation
of solar energy devices; prohibiting certain
installation of solar energy devices; providing for
codification; and declaring an emergency.
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 820.6 of Title 17, unless there
is created a duplication in numbering, reads as follows:
A. For the purposes of this section, “agricultural land”
includes any land used primarily for farming, ranching, or other
agricultural purposes as determined by the Oklahoma Department of
Agriculture, Food, and Forestry.
B. Notwithstanding any other provision of law, a solar energy
device, as defined in Section 820.1 of Title 17 of the Oklahoma
Statutes, shall only be permitted for installation on the following:
1. Single-family residential properties; and
2. Commercial or industrial properties.

C. On or after the effective date of this act, solar energy
devices shall not be installed, maintained, or retained on
agricultural land.
SECTION 2. It being immediately necessary for the preservation
of the public peace, health or safety, an emergency is hereby
declared to exist, by reason whereof this act shall take effect and
be in full force from and after its passage and approval.
