AS INTRODUCED

An Act relating to state fiscal affairs; creating the
Flat Budget Act; providing short title; prohibiting
certain appropriations from exceeding certain amount;
requiring the State Treasurer to transfer certain
funds; providing for noncodification; providing for
codification; providing an effective date; and
declaring an emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law not to be
codified in the Oklahoma Statutes reads as follows:
This act shall be known and may be cited as the “Flat Budget
Act”.
SECTION 2. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 34.42.2 of Title 62, unless
there is created a duplication in numbering, reads as follows:
A. No state agency or entity that receives appropriated funds
shall receive a larger appropriation for the fiscal year 2027 than
such agency or entity received in fiscal year 2026.
B. For any agency that receives funds in excess of the
limitation provided in subsection A of this section, the State

Treasurer shall transfer such excess to the General Revenue Fund for
fiscal year 2027.
SECTION 3. This act shall become effective July 1, 2026.
SECTION 4. It being immediately necessary for the preservation
of the public peace, health or safety, an emergency is hereby
declared to exist, by reason whereof this act shall take effect and
be in full force from and after its passage and approval.
