SENATE BILL 791 By: Jett

AS INTRODUCED

An Act relating to banks and trust companies;
prohibiting certain institutions from providing
certain information to certain agents; requiring
certain notice; establishing certain penalties;
establishing certain exceptions; and declaring an
emergency.

BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified
in the Oklahoma Statutes as Section 3004 of Title 6, unless there is
created a duplication in numbering, reads as follows:
A. A bank, credit union, or financial institution in this state
shall not provide details regarding the financial accounts or
financial transactions of an individual, business, or trust in this
state to any federal agent or agency making such request for
information.
B. Upon any request for information, the bank, credit union, or
financial institution shall notify the owner or manager of the
individual, business, or trust account of the request within two (2)
business days. The notification shall include:

1. The date and time of the request;
2. The requestor, including, but not limited to, the agent and
any potential agents; and
3. Other pertinent information;
C. Any financial institution that provides personal information
shall be subject to a fine of Ten Thousand Dollars ($10,000.00) for
a first offense. A second offense shall subject the financial
institution to a loss of license to operate in this state.
D. Nothing in this section shall be construed to apply to
requests for information based on warrant, court order, or clearly
articulated and written probable cause requesting the information.
SECTION 2. It being immediately necessary for the preservation
of the public peace, health or safety, an emergency is hereby
declared to exist, by reason whereof this act shall take effect and
be in full force from and after its passage and approval.
