STATE OF OKLAHOMA
2nd Session of the 60th Legislature (2026)
SENATE
RESOLUTION 26 By: Grellner
AS INTRODUCED
A Resolution supporting Senate Bill 1640; urging
expeditious committee and floor consideration; and
affirming the Senate’s commitment to enforcing its
rules and the Oklahoma Constitution by condemning
intoxication during session.
WHEREAS, Senate Rule 5-5 D. of the Standing Rules of the Senate
for the 60th Oklahoma Legislature (2025-2026) prohibits the
consumption of alcohol in the chamber and mandates removal by
security personnel of any member in an intoxicated state; and
WHEREAS, Article 2, Section 11 of the Oklahoma Constitution
declares that “Drunkenness and the excessive use of intoxicating
liquors while in office shall constitute sufficient cause for
impeachment or removal therefrom”; and
WHEREAS, incidents during the 2025 legislative session
highlighted apparent violations of these provisions, with no
enforcement action taken; and
WHEREAS, Senator Shane Jett has introduced Senate Bill 1640 to
strengthen prohibitions on alcohol consumption or possession by

lawmakers while on duty in the Capitol, including provisions for
Breathalyzer testing, escalating penalties (fines, expulsion,
mandatory treatment), ethics referrals, and accountability for
leadership failing to act; and
WHEREAS, swift passage of such measures would demonstrate the
Senate’s unwavering commitment to sobriety, accountability, and
adherence to its own rules and the Oklahoma Constitution.
NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE 2ND SESSION
OF THE 60TH OKLAHOMA LEGISLATURE:
THAT the Senate strongly supports Senate Bill 1640 as a
necessary step to reinforce existing rules and constitutional
standards prohibiting intoxication during official duties.
THAT the Senate urges the appropriate committee(s) to grant
Senate Bill 1640 a hearing at the earliest possible date, and calls
for expeditious floor consideration and passage to affirm that the
Oklahoma State Senate stands firmly by its rules and the Oklahoma
Constitution.
THAT the Senate condemns intoxication in the chamber during
session as incompatible with the dignity and responsibility of
legislative service and reaffirms its expectation of sober,
professional conduct by all members.
