A BILL FOR AN ACT
Relating to behavioral health; and declaring an emergency.
Whereas community mental health programs provide critical mental health and substance use
disorder services to individuals in their communities; and
Whereas community mental health programs are required by statute to provide specific services
to individuals experiencing a behavioral health crisis, individuals charged with a crime and found
unable to aid and assist in their own defense and individuals subject to civil commitment pro-
ceedings; and
Whereas the Oregon Health Authority conducted, pursuant to section 1, chapter 80, Oregon
Laws 2024, a cost study to determine the funding required for each community mental health pro-
gram to provide those services; and
Whereas the cost study, which was completed with the assistance of an actuary, determined that
there is a gap between the funding that is currently available and the funding that is needed for
community mental health programs to provide the services required by statute; now, therefore,
Be It Enacted by the People of the State of Oregon:
SECTION 1.
In addition to and not in lieu of any other appropriation, there is appropri-
ated to the Oregon Health Authority, for the biennium beginning July 1, 2025, out of the
General Fund, the amount of $64,800,000, for distribution to community mental health pro-
grams for the purpose of carrying out the provisions of ORS 161.315 to 161.351, 161.355 to
161.371, 161.385 to 161.395, 161.505 to 161.585, 426.005 to 426.390, 426.510 to 426.680, 426.701,
426.702, 430.627, 430.628, 430.629 and 430.630.
SECTION 2.
This 2025 Act being necessary for the immediate preservation of the public
peace, health and safety, an emergency is declared to exist, and this 2025 Act takes effect
