A RESOLUTION
Directing the Joint State Government Commission to conduct a
study on litter law enforcement and provide recommendations.
WHEREAS, Litter has a range of harmful effects, harming
wildlife and the environment, threatening public health and
reducing quality of life and community appearance; and
WHEREAS, Litter cleanup, prevention and mitigation is
expensive for the Commonwealth, costing State agencies and local
governments tens of millions of dollars each year; and
WHEREAS, The Pennsylvania Litter Research Study concluded
that there were more than half a billion pieces of litter on
Pennsylvania roadways; and
WHEREAS, That study conducted a public attitudes survey that
found that more than 90% of Pennsylvanians reported that litter
is a problem, however most also find it unlikely for someone to
be caught or fined because of littering; and
WHEREAS, The Pennsylvania Litter Research Study recommended
evaluating the effectiveness of ordinances, laws and statutes as

they relate to reducing litter, as well as why current litter
regulations are not being enforced; and
WHEREAS, The subsequent Pennsylvania Litter Action Plan
called on the General Assembly to review and update
Pennsylvania's litter laws to ensure prevention and enforcement;
therefore be it
RESOLVED, That the House of Representatives direct the Joint
State Government Commission to conduct a study of the
effectiveness and enforcement of litter laws and regulations and
provide recommendations; and be it further
RESOLVED, That the Joint State Government Commission's study
on litter law enforcement, at a minimum, include the following:
(1) A review and analysis of the effectiveness of the
current ordinances, laws and statutes that relate to reducing
litter in Pennsylvania.
(2) A review and analysis of the challenges that exist
in enforcing existing litter-related laws and regulations.
(3) A review of community service requirements imposed
as penalties for littering and related offenses and the
extent to which litter cleanup is being required and
performed as part of community service sentencing.
(4) A review of litter-related policies, strategies,
laws and regulations in other states in the nation, including
the enforcement, penalties and relevant funding mechanisms.
(5) Policy and legislative recommendations that would
improve the enforcement of litter-related laws and
regulations.
(6) Recommendations for improvements in the coordination
and availability of community service programs engaged in
litter cleanup.

(7) Recommendations for funding sources that could be
used to support programs for litter education, mitigation,
prevention and cleanup.
(8) Any other matter deemed appropriate by the Joint
State Government Commission;
and be it further
RESOLVED, That the Joint State Government Commission be
authorized to consult with other states and organizations that
have knowledge of relevant issues; and be it further
RESOLVED, That the Joint State Government Commission consult
with:
(1) relevant State agencies;
(2) nonprofit organizations involved in litter
education, prevention and cleanup;
(3) local governments; and
(4) individuals involved in the enforcement of litter-
related laws, including law enforcement officers, prosecutors
and judges when conducting their study;
and be it further
RESOLVED, That the Joint State Government Commission present
its report to the House of Representatives no later than 12
months after the adoption of this resolution.
