Potter Date Introduced: February 12, 2026 Referred To: House Health & Human Services It is enacted by the General Assembly as follows: 1 SECTION 1. Section 27-18-33 of the General Laws in Chapter 27-18 entitled "Accident 2 and Sickness Insurance Policies" is hereby amended to read as follows: 3 27-18-33. Drug coverage. 4 No Any group health insurer subject to the provisions of this chapter that provides coverage 5 for prescription drugs under a group plan master contract delivered, issued for delivery, or renewed 6 in this state shall offer a minimum of two (2) options for the delivery of prescription drugs, but is 7 prohibited from requiring may require any person covered under the contract to obtain prescription 8 drugs from a mail order pharmacy as a condition of obtaining benefits for the drugs. 9 SECTION 2. Section 27-19-26 of the General Laws in Chapter 27-19 entitled "Nonprofit 10 Hospital Service Corporations" is hereby amended to read as follows: 11 27-19-26. Drug coverage. 12 No Any group health insurer subject to the provisions of this chapter that provides coverage 13 for prescription drugs under a group plan master contract delivered, issued for delivery, or renewed 14 in this state shall offer a minimum of two (2) options for the delivery of prescription drugs, but is 15 prohibited from requiring may require any person covered under the contract to obtain prescription 16 drugs from a mail order pharmacy as a condition of obtaining benefits for the drugs. 17 SECTION 3. Section 27-20-23 of the General Laws in Chapter 27-20 entitled "Nonprofit 18 Medical Service Corporations" is hereby amended to read as follows: 19 27-20-23. Drug coverage. 9 No Any health maintenance organization that provides coverage for prescription drugs 10 under a group plan master contract delivered, issued for delivery, or renewed in this state shall offer 11 a minimum of two (2) options for the delivery of prescription drugs, but is prohibited from requiring 12 may require any person covered under the contract to obtain prescription drugs from a mail order 13 pharmacy as a condition of obtaining benefits for the drugs. 14 SECTION 5.
