H7927 2026 -- H 7927 ======== LC005763 ======== STATE OF RHODE ISLAND IN GENERAL ASSEMBLY JANUARY SESSION, A.D. 2026 ____________ A N A C T RELATING TO HEALTH AND SAFETY -- ELECTRONIC MONITORING IN NURSING AND ASSISTED LIVING FACILITIES Introduced By: Representatives Knight, Boylan, Alzate, Serpa, Fellela, Corvese, Kislak, McEntee, and Cortvriend Date Introduced: February 27, 2026 Referred To: House Health & Human Services It is enacted by the General Assembly as follows: 1 SECTION 1. Section 23-17.29-7 of the General Laws in Chapter 23-17.29 entitled 2 "Electronic Monitoring in Nursing and Assisted Living Facilities" is hereby amended to read as 3 follows: 4 23-17.29-7. Costs and installation. 5 (a) A resident or resident representative choosing to conduct electronic monitoring shall do 6 so at the resident’s own expense, including the purchase, installation, maintenance, and removal 7 costs. 8 (b) Any device used by a resident to conduct authorized electronic monitoring shall meet 9 the following minimum functional requirements: 10 (1) Include timestamping of all video recordings; and 11 (2) If movement tracking is a default setting, that the device must be able to switch off this 12 function. 13 (c) If a resident chooses to place an electronic monitoring device that uses internet 14 technology for visual or audio monitoring, the resident shall be responsible for contracting with an 15 internet service provider except that in the event the facility provides internet access to the residents, 16 then the resident may connect the electronic monitoring device to the facility's internet service for 17 use with said service without incurring extra cost or charges . 18 (d) All electronic monitoring device installations and supporting services shall be UL- 1 listed. 2 (e) The electronic monitoring device must be placed in a conspicuously visible location in 3 the room. 4 (f) A facility shall not charge the resident a fee for the cost of electricity used by an 5 electronic monitoring device. 6 SECTION 2.
