An Act to require that the secretary of the Department of Education apply to the 1
United States Department of Education for the authority to develop and 2
implement an innovative assessment system. 3
Section 1. The secretary of the South Dakota Department of Education shall apply to the 4
United States Department of Education, pursuant to 20 U.S.C. § 6364 (January 1, 2026), for 5
the authority to establish an innovative assessment system. 6
Section 2. Upon receipt of a notice indicating that the secretary's application has been 7
approved by the United States Department of Education, the secretary shall, in consultation 8
with school administrators, teachers, parents, and other education experts, develop and 9
implement an assessment model that: 10
(1) Meets the requirements for an innovative assessment system established in 20 11
U.S.C. § 6364 (January 1, 2026); 12
(2) Corresponds with the requirements for an academic achievement assessment 13
established in § 13-3-55; 14
(3) Accurately measures student growth in reading and mathematics; 15
(4) Aligns with evidence-based literacy practices founded upon the science of reading; 16
and 17
(5) Reinforces the mastery of foundational mathematics skills. 18
