An Act to prohibit COVID -19 vaccination requirements and to provide a penalty 1
therefor. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
Section 1. That a NEW SECTION be added to chapter 34-22: 4
Notwithstanding any other provision of law, no employer, educational institution, 5
state agency, political subdivision, or other person may require an individual to receive a 6
COVID-19 vaccination as a condition of employment, enrollment, or for the receipt of a 7
benefit or service. 8
A violation of this section is a Class 2 misdemeanor. 9
