An Act to increase communication between agencies of this state and tribal 1
governments. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
Section 1. That a NEW SECTION be added to chapter 1-54: 4
At least once each calendar year, the officers and employees of each state agency 5
shall complete a training provided by an individual selected by the governments of each 6
Indian tribe. The training must include: 7
(1) The legal status of each Indian tribe; 8
(2) The legal rights of the members of each Indian tribe; and 9
(3) Any social, economic, and cultural issues of concern to each Indian tribe. 10
Section 2. That a NEW SECTION be added to chapter 1-54: 11
At least once each year, the Governor, the heads of each state agency, and tribal 12
officials from each Indian tribe, shall meet to discuss: 13
(1) Tribal concerns with the administrative rules and agency policies that directly 14
impact tribal government or tribal populations; 15
(2) Other issues of concern to either the state or the tribes; and 16
(3) Potential solutions to the concerns raised in subdivision (1) or (2). 17
Section 3. That a NEW SECTION be added to chapter 1-54: 18
On or before August fifteenth of each year, a state agency shall report to the 19
Governor, detailing the activities of the state agency relating to tribal governments or 20
tribal populations for the previous fiscal year. The report must include: 21
(1) Any administrative rule or agency policy change that the agency has adopted 22
because of the meeting held pursuant to section 2 of this Act; 23

(2) The process that the state agency has established to identify activities of the state 1
agency that relate to tribal governments or tribal populations; 2
(3) The efforts made by the state agency to promote communication with tribal 3
governments and the government -to-government relationship between the state 4
agency and each tribe; and 5
(4) The efforts made by the state agency to ensure tribal consultation and the use of 6
American Indian data in the development and implementation of agency programs 7
that directly relate to tribal governments or tribal populations. 8
On or before September fifteenth of each year, the Governor shall provide to each 9
tribal government a report detailing all state activities, as they relate to tribal governments 10
or tribal populations, for the prior fiscal year. 11
