A CONCURRENT RESOLUTION encouraging the Executive Board of the Legislative 1
Research Council to form an interim legislative committee Neurohealth Safety 2
Committee to study and assess unregulated vapor products the regulatory 3
framework under which tobacco and vapor product retail establishments 4

WHEREAS, the health of a state and its institutions depends on the health of its citizens; 6
and 7
WHEREAS, the health of our future citizenry rests on the health of our youth; and 8
WHEREAS, our youth are increasingly using substances that may be deleterious to their 9
mental and physical health in both the long term and the short term; and 10
WHEREAS, vapor products containing intoxicating substances threaten the future health 11
of our state and are often unregulated and of unknown origin; and 12
WHEREAS, the popular perception that the availability of intoxicating vapor products in 13
smoke shops and other retail establishments is a reliable indicator of the products' safety, is 14
erroneous; and 15
WHEREAS, this erroneous perception may be dispelled only by knowledge, information, 16
and insight gained through a careful assessment of the situation in our state; 17
WHEREAS, rules that are unclear in their intent and direction create compliance challenges 18
for tobacco and vapor product retailers; and 19
WHEREAS, the lack of clarity has the potential to affect a variety of regulatory areas, 20
including the payment of fees and the scheduling and conduct of compliance inspections; and 21

WHEREAS, a committee that brings interested parties into a conversation about rules and 9
compliance stands the best chance of clarifying the future obligations of all parties; 10
NOW, THEREFORE, BE IT RESOLVED, by the House of Representatives of the One Hundred 11
First Legislature of the State of South Dakota, the Senate concurring therein, that the 12
Executive Board of the Legislative Research Council be encouraged to form the interim 13
Neurohealth Safety Committee for the purpose of studying the regulatory framework under 14
which tobacco and vapor product retailers operate and to assess the extent of the need for 15
further regulatory action.
