A CONCURRENT RESOLUTION honoring Custer State Park cabin owners and their 1
property rights. 2
WHEREAS, when Custer State Park was created, then Governor Vassey encouraged 3
private citizens to build cabins in the park to attract more visitors; and 4
WHEREAS, today there are thirty-seven privately owned cabins in the park, on land leased 5
from Custer State Park; and 6
WHEREAS, the cabin owners pay property tax on the land leased from Custer County, pay 7
their lease payments to Custer State Park, and contribute regularly to the needs of the park 8
through the Custer State Park Foundation; and 9
WHEREAS, most cabin owners' leases expire in a few years; and 10
WHEREAS, the recent wind storms in the park have damaged some of the cabins, which 11
has accentuated the need to create some certainty as to the future of the cabins in the park; 12
and 13
WHEREAS, the cabin owners have a long legacy with the park and consider themselves 14
guardians of the park and its heritage; and 15
WHEREAS, the cabin owners have property rights that need to be respected and honored, 16
and time is of the essence to address these issues; and 17
WHEREAS, the South Dakota Legislature can help these cabin owners by ensuring their 18
property interests are protected and their place in the legacy of the park and the state 19
continues; 20

NOW, THEREFORE, BE IT RESOLVED, by the House of Representatives of the One Hundred 1
First Legislature of the State of South Dakota, the Senate concurring therein, that the 2
Legislature endorses the cabin owners' property rights in Custer State Park, and their desire 3
to know their future in the park, and encourages the state to embrace the cabin owners as 4
important to the park's future; and 5
BE IT FURTHER RESOLVED, that the Governor and the Department of Game, Fish and 6
Parks be encouraged to create new leases with the cabin owners, so the cabin owners may 7
secure their future and enhance the park as quickly as possible. 8
