An Act to limit the potency of cannabis products sold at medical cannabis 1
dispensaries. 2
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 3
Section 1. That a NEW SECTION be added to chapter 34-20G: 4
A medical cannabis dispensary licensed under this chapter may not acquire, 5
cultivate, deliver, dispense, distribute, possess, produce, sell, store, supply, transfer, or 6
transport: 7
(1) Cannabis flower that exceeds thirty percent tetrahydrocannabinol; 8
(2) A liquid concentrate cannabis product that exceeds sixty percent 9
tetrahydrocannabinol; 10
(3) An edible cannabis product that exceeds five milligrams tetrahydrocannabinol per 11
serving; 12
(4) An edible cannabis product that exceeds one hundred milligrams 13
tetrahydrocannabinol per container; and 14
(5) A cannabis oil that exceeds five percent tetrahydrocannabinol. 15
