AMENDMENT SCR606A FOR THE INTRODUCED RESOLUTION A CONCURRENT RESOLUTION encouraging the South Dakota Conservancy District 1 to obtain and hold a future use permit of review and approval of water rights 2 applications and future use reservations from the Missouri River water for the 3 long-term needs of this state.
4 WHEREAS, under SDCL 46-1-1 to 46-1-4, inclusive, the people of South Dakota have a 5 paramount interest in the use of all water within this state, which is declared to be the 6 property of the people, and the state shall ensure that water resources are developed for the 7 greatest public benefit, put to beneficial use to the fullest extent possible, and not wasted or 8 used unreasonably; and 9 WHEREAS, the demand for water is increasing in many parts of the western United States; 10 and 11 WHEREAS, the Missouri River remains is the state's most crucial single substantial surface 12 water source of water in this state; and 13 WHEREAS, SDCL 46-5-38 authorizes several certain entities to reserve water for 14 contemplated future needs upon a showing of availability of unappropriated water and future 15 need pursuant to the procedures set forth in chapter 46-2A; and 16 WHEREAS, no entity has yet filed a future use permit that looks to the long -term needs 17 of people of this state; and 18 WHEREAS, the South Dakota Conservancy District Water Management Board is a 19 statewide organization board, created by the Legislature for the purpose of planning, 20 developing, and equitably managing the use and conservation of water resources in of this 21 state; 22 NOW, THEREFORE, BE IT RESOLVED, by the Senate of the One Hundred First Legislature 23 of the State of South Dakota, the House of Representatives concurring therein, that it is of 24 SCR606A 2 SCR606 Underscores indicate new language.

AN ACT

A CONCURRENT RESOLUTION encouraging the review and approval of water rights
applications and future use reservations from the Missouri River.
WHEREAS, under SDCL 46-1-1 to 46-1-4, inclusive, the people of South Dakota have a
paramount interest in the use of all water within this state, which is declared to be the
property of the people, and the state shall ensure that water resources are developed for the
greatest public benefit, put to beneficial use to the fullest extent possible, and not wasted or
used unreasonably; and
WHEREAS, the demand for water is increasing in many parts of the western United States;
and
WHEREAS, the Missouri River is the state's most substantial surface water source; and
WHEREAS, SDCL 46-5-38 authorizes certain entities to reserve water for contemplated
future needs upon a showing of availability of unappropriated water and future need pursuant
to procedures set forth in chapter 46-2A; and
WHEREAS, the Water Management Board is a statewide board, created by the Legislature
for the purpose of equitably managing the water resources of this state;
NOW, THEREFORE, BE IT RESOLVED, by the Senate of the One Hundred First Legislature
of the State of South Dakota, the House of Representatives concurring therein, that it is of
the utmost importance that the Water Management Board prioritize the review and approval
of water rights applications and future use reservations from the Missouri River submitted by
South Dakota's public water systems to address the future needs of the people of this state .
