A JOINT RESOLUTION proposing and submitting to the voters at the next general 1
election an amendment to the Constitution of the State of South Dakota, 2
limiting the number of terms an individual may serve as a member of the 3
Legislature. 4
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA: 5
Section 1. That at the next general election held in the state, the following amendment to 6
Article III of the Constitution of the State of South Dakota, as set forth in section 2 of this 7
Joint Resolution, which is hereby agreed to, be submitted to the electors of the state for 8
approval. 9
Section 2. That Article III, § 6 of the Constitution of the State of South Dakota, be 10
AMENDED: 11
§ 6. The terms of office of the members of the Legislature shall be two years; they 12
shall receive for their services the salary fixed by law under the provisions of § 2 of article 13
XXI of this Constitution, and five cents for every mile of necessary travel in going to and 14
returning from the place of meeting of the Legislature on the most usual route. 15
No person An individual may serve not be elected to more than four consecutive 16
terms or a total of eight consecutive years in the senate and Senate or more than four 17
consecutive terms or a total of eight consecutive years in the house of representatives. 18
However, this restriction does not apply to partial terms to which a legislator may be 19
appointed House of Representatives. An individual may not be elected to more than eight 20
consecutive terms or a total of sixteen consecutive years as a member of the Legislature. 21
Any partial term for which an individual is appointed, pursuant to Article IV, § 3 of this 22
Constitution, is not counted toward the number of terms to which an individual may be 23
elected as a member of either the Senate or the House of Representatives. 24
A regular session of the Legislature shall be held each year and shall not exceed 25
forty legislative days, excluding Sundays, holidays and legislative recess, except in cases 26
