Historic Preservation Act

This act restricts the Tennessee Historical Commission and other state entities from regulating or penalizing property owners for changes to buildings that are not listed on the Tennessee register of historic places, unless those properties meet specific criteria.

What This Bill Does

  • Prohibits the Tennessee Historical Commission and other state entities from approving or recommending changes to structural design elements of buildings that might be historically significant but are not yet officially recognized as such.
  • Prevents these entities from penalizing property owners for renovating, altering, or demolishing their properties if those properties do not meet certain criteria for historic preservation.
  • Requires the Tennessee Historical Commission to review community development block grants related to properties meeting specific criteria within 15 business days after the law takes effect.

Who It Names or Affects

  • The Tennessee Historical Commission and other state entities involved in historic preservation
  • Property owners whose buildings might be historically significant but are not yet officially recognized as such

Terms To Know

Historic Preservation
Protecting and preserving buildings, structures, objects, sites, or districts that have historical significance.
Tennessee Register of Historic Places
A list maintained by the Tennessee Historical Commission of properties with recognized historic value in the state.

Limits and Unknowns

  • The act could affect federal funding for historic preservation projects if it conflicts with existing laws like the National Historic Preservation Act.
  • It is unclear how this law will impact grants awarded to local governments and non-profits for historic preservation efforts.

Amendments

These notes stay tied to the official amendment files and metadata from the legislature.

Amendment 1-0 to HB0073

Plain English: The amendment removes regulations on renovating, altering, or demolishing certain properties that are not listed on the Tennessee Register of Historic Places.

  • Removes the ability of the Tennessee Historical Commission and other state entities (except for the State Building Commission) to regulate renovations, alterations, or demolition of real property that is not listed on the Tennessee Register of Historic Places.
  • Prevents these entities from taking any negative actions against owners of such properties if those properties have been considered but declined listing on the register or have never received protection, grants, or other benefits associated with eligibility for the register.
  • The amendment text does not specify what 'adverse action' means in detail.
  • It is unclear how this will affect properties that are eligible but not yet listed on the Tennessee Register of Historic Places.
Amendment 2-0 to HB0073

Plain English: This amendment changes how quickly the Tennessee Historical Commission must review information about community development block grants for certain properties.

  • The historical commission now has fifteen business days to complete its review of relevant information related to a community development block grant for specific properties.
  • If the commission fails to meet this deadline, it will be required to appear before the joint government operations committee to explain why.
  • The amendment does not specify what happens if the commission appears but still cannot justify its noncompliance.
Amendment 1-0 to SB0007

Plain English: The amendment removes the ability of the Tennessee Historical Commission and other state entities (except the State Building Commission) to regulate or take adverse actions against property owners for renovating, altering, or demolishing real property that is not listed on the Tennessee Register of Historic Places.

  • Removes the authority of the Tennessee Historical Commission and other state entities from regulating or taking negative actions regarding properties not listed on the Tennessee Register of Historic Places if those properties have been considered but not added to the register, or have received no benefits related to historic preservation.
  • The amendment text does not specify what constitutes 'adverse action' and how it will be enforced.
  • It is unclear which state entities other than the State Building Commission are affected by this change.
