Plain English Breakdown

The official source material does not provide details on the exact requirements and implications of using third-party inspectors for unrelated inspections, leading to uncertainty in this area.

Building Inspection Changes

This bill changes the time limit for inspecting a building's foundation from one working day to two working days and requires third-party inspectors to do follow-up inspections if they did an initial one.

What This Bill Does

  • Changes the time limit for inspecting a building's foundation from one working day to two working days.
  • Requires that if someone uses a third-party inspector for a local building inspection, they must use another third-party inspector for any follow-up inspections related to that original inspection.

Who It Names or Affects

  • Builders and property owners who need building inspections in Tennessee.
  • Third-party inspectors hired for local building inspections.

Terms To Know

Building inspection
A check to make sure a building is safe and meets rules before it can be used or sold.
Third-party inspector
An independent person hired by someone else to do inspections, not the government or the builder.

Limits and Unknowns

  • The bill does not specify what happens if a follow-up inspection is needed but no third-party inspector is available.
  • It's unclear how this will affect small towns with limited access to third-party inspectors.

Amendments

These notes stay tied to the official amendment files and metadata from the legislature.

Amendment 1-0 to HB1760

Plain English: The amendment changes a part of Tennessee law about building inspections by specifying when third-party inspectors must be used for follow-up inspections.

  • Changes the requirement for using third-party inspectors to conduct subsequent inspections related to locally required building inspections if a third-party inspector was initially hired.
  • The amendment text is technical and does not provide clear examples of what constitutes 'subsequent inspection' or how it differs from other types of inspections.
  • It's unclear how this change will affect the overall process of building inspections in Tennessee.
Amendment 1-0 to SB1784

Plain English: The amendment changes a part of Tennessee law about building inspections by specifying when third-party inspectors must be used for follow-up inspections.

  • Adds rules requiring the use of third-party inspectors for subsequent inspections related to initial locally required building inspections if a third-party inspector was initially hired.
  • The amendment text does not provide details on how this change will be enforced or what happens if someone doesn't follow these new rules.
  • It's unclear from the provided information which specific sections of Tennessee Code Annotated are being amended beyond Section 68-120-101(k)(3)(B).

Official Summary Text

ON APRIL 6,
2026, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 1760, AS AMENDED.

AMENDMENT #1 rewrites the bill to, instead, expand present law's requirements for when a person engages a third-party inspector to complete locally required building inspections, as authorized in present law's statewide building construction safety stand
ards.

In addition to present law, this amendment requires the person or the person's designee to utilize a third-party inspector to conduct any subsequent inspections in the inspection category for which a third-party inspector was initially utilized. If a pe
rson engages a third-party inspector to complete locally required building inspections as authorized, then the person, or the person's designee, must utilize a third-party inspector to conduct any subsequent inspection related to the locally required buil
di
ng inspection for which the person initially engaged the third-party inspector.

However, this amendment does not require a person who engages a third-party inspector to complete a locally required building inspection to engage a third-party inspector for another locally required building inspection other than an inspection related t
o the locally required building inspection for which the person initially engaged the third-party inspector.

This amendment applies to actions taken, and conduct occurring, on or after July 1, 2026.
