Video Camera Surveillance in Special Education Classrooms

This bill allows local education agencies (LEAs) and public charter schools to install video cameras in special education classrooms with parental consent, for the purpose of monitoring safety.

What This Bill Does

  • Allows LEAs and public charter schools to put video cameras in special education classrooms to keep teachers and students safe.
  • Requires that parents must agree in writing before a school can use these cameras to watch students, teachers, and staff continuously while they are receiving special education services.
  • Permits the viewing of photos or videos by parents if their child is featured, as long as it follows state and federal privacy rules.
  • Allows teachers who believe there's evidence of an assault on them to view footage under privacy law conditions.
  • Requires LEAs and public charter schools that use cameras to make a policy about how long they keep the video recordings.

Who It Names or Affects

  • Local education agencies (LEAs) and public charter schools in Tennessee
  • Parents of students receiving special education services
  • Teachers, staff, and students in special education classrooms

Limits and Unknowns

  • The bill does not specify how much funding will be available through school safety grants.
  • It is unclear exactly when and if additional funds will be allocated for this purpose beyond what is currently available.
  • The exact number of schools that might install cameras cannot be determined.

Amendments

These notes stay tied to the official amendment files and metadata from the legislature.

Amendment 1-0 to SB2485

Plain English: The amendment adds requirements for local education agencies and public charter schools regarding the use of video camera surveillance systems in special education classrooms.

  • An LEA or public charter school cannot continuously monitor students, teachers, and staff with a video camera unless all teachers and staff consent in writing and parents of most students also give written permission.
  • If a parent does not agree to their child being monitored by the system, the school cannot use any photos or recordings made by the surveillance system for disciplining, assigning, or placing that student.
  • The amendment text does not specify what happens if consent is not given by teachers and staff or parents of students.
  • It's unclear how this will affect existing surveillance systems in special education classrooms.
