ON MARCH 19, 2026, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 2273, AS AMENDED.

AMENDMENT #1 r
ewrites this bill to add an exception to the definition of "transfer fee covenant".

Present law provides that a transfer fee covenant recorded after June 10, 2011, or any lien to the extent that it purports to secure the payment of a transfer fee, is not binding on or enforceable against the affected real property or any subsequent owne
r, purchaser, or mortgagee of any interest in the property.

This amendment provides that a

provision of a document requiring a transferor or transferee to pay a fee, charge, assessment, dues, contribution, deposit, or other amount to purchase, issue, reissue, maintain, or transfer a club membership that is related to the real property or the co
mmunity in which the property is sited

AN ACT to amend Tennessee Code Annotated, Title 66,
relative to real property.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 66-4-403(a)(1)(B), is amended by
deleting "three (3)" and substituting "five (5)".
SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it.
