Plain English Breakdown

The official source material does not provide details on enforcement or penalties for non-compliance with the $50.00 cap.

Blasting Safety Regulations

This bill changes Tennessee's laws about blasting by setting a $50.00 cap on charges for providing pre-blast survey documents to owners and occupants of buildings within 300 feet of the blast area.

What This Bill Does

  • Sets a $50.00 cap on the amount that may be charged for providing copies of pre-blast surveys to owners and occupants of certain buildings near blasting sites.

Who It Names or Affects

  • Owners and occupants of houses, public buildings, schools, churches, commercial buildings, and institutions within 300 feet of a blast hole.
  • Blasting companies that conduct pre-blast surveys for these nearby buildings.

Terms To Know

pre-blast survey
A safety check done before a blast to understand the area around it.
blasting firm
A company that performs controlled explosions for construction or mining purposes.

Limits and Unknowns

  • The bill does not specify what happens if a blasting company fails to provide these documents within the $50.00 cap.
  • It is unclear how the requirement of no cost provision applies in practice, as there is now a $50.00 cap.

Amendments

These notes stay tied to the official amendment files and metadata from the legislature.

Amendment 1-0 to SB0566

Plain English: The amendment changes Tennessee law by adding requirements for blasting firms to offer free pre-blast surveys and provide documentation to owners or occupants of buildings near blast sites under certain conditions.

  • Blasting firms must now offer a free pre-blast survey to the owner or occupant of any building within 300 feet of a blast hole, if the standard distance is exceeded. The offer must be made in writing at least 72 hours before blasting starts.
  • Owners or occupants can request complete documentation of surveys from the blasting firm and the cost for this service cannot exceed $50.
  • These requirements do not apply to permanent blasting operations.
  • The amendment does not specify what constitutes a 'permanent blasting operation'.
