Present law authorizes

a
local board of education member that is elected, or appointed to fill a vacancy,
to
be removed from office by the registered voters of the county.
A
governmental entity having a charter provision for a petition for recall, referendum
,
or initiative
must
meet requirements and procedures set out by this state. Certain counties are excluded from this provision, including, c
ount
ies

with
a metropolitan form of government and a population greater than 100,000
, and Madison County, and can thereby
establish
thei
r
own recall procedures
. This bill removes the exception for Madison County.

AN ACT to amend Tennessee Code Annotated, Title 2 and
Title 49, Chapter 2, relative to recall elections for
members of local boards of education.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Section 49-2-213, is amended by deleting
subsection (e).
SECTION 2. This act takes effect upon becoming a law, the public welfare requiring it.
